Privacy Policy & Terms Of Use

1) Personal Information RiseFuel Collects

“Personal Information” is information that can be used to identify, locate, or contact an individual. RiseFuel collects the following types of Personal Information:

Contact Information. Contact Information allows RiseFuel to communicate with you. Examples of Contact Information include, but are not limited to, your name, accurate postal addresses, valid email address, or other addresses at which you receive communications from or on behalf of RiseFuel.

Transaction Information. RiseFuel automatically receives and records some information from your browser when you visit the site, such as your IP address, cookies and data about which pages you visit on the site through the use of log files provided by our third-party tracking-utility partners. This information helps us analyze and understand how the site works for users. Information that is gathered includes, but is not limited to, information about how you interact with RiseFuel, information about how you use RiseFuels Sites, email, other communications, and applications, and how you interact with other users and RiseFuel business partners.

Mobile Location Information. If you have permitted your mobile or other location-aware device to transmit location data, RiseFuel collects Mobile Location.

Posted Information. If you chose to post a comment on our blog, we may collect information regarding your name and the content of your post It is important to note that any content you post on the blog is publicly displayed and will be seen by other users of the Site.

2) How RiseFuel Collects Personal Information

RiseFuel prompts you to provide Personal Information (including Contact Information) when you use RiseFuel or otherwise interact with the Site or contact RiseFuel.

RiseFuel collects Transaction Information when you use the Site. For example, RiseFuel may track the pages you view, the methods of communication that may be offered on or through the Site from time to time. RiseFuel uses cookies and related technologies to collect information about your computer and your interaction with the Site and our partner websites.

RiseFuel also collects Transaction Information if and when you contact RiseFuel via telephone, email, or other methods of communication.

3) How RiseFuel Uses Personal Information

We may use Personal Information to enhance to enhance your user experience, to help us better understand you, to help us customize offers, blog topics, or posts that may be of interest to you, and to help us otherwise enhance the Site.

RiseFuel uses Personal Information to:

  • Identify and authenticate users;
  • Facilitate transactions;
  • Operate and improve the Site;
  • Connect with you on social media (such as Facebook, LinkedIn, or Twitter);
  • Contact you by phone or email;
  • Personalize and continually improve users’ RiseFuel experience;
  • Provide you with suggested information based on variables such as stated preferences, interests, business activities, and/or location;
  • Send you technical notices, updates, alerts and support and administrative messages service bulletins, or marketing;
  • Evaluate additional services, items, or offerings that may be of interest to users;
  • Track transactions and perform other analytics;
  • Communicate and provide additional information that may be of interest to you about RiseFuel partners or third parties; and
  • Manage RiseFuel everyday business needs such as Site administration, communication management, analytics, fraud prevention, enforcement of our corporate reporting obligations, Terms of Use or to comply with the law.
4) When and Why RiseFuel Discloses Personal Information

RiseFuel will not disclose your Personal Information to third parties without your explicit consent, except as specified in this Privacy statement. RiseFuel will disclose your Personal Information when:

  • Working with companies and service providers (i.e. HubSpot, SalesForce.com, or other companies that process billing, website hosting, or analytics performance in furtherance of the purposes described in Section 3 (“How RiseFuel Uses Personal Information”) above.
  • RiseFuel employs other companies to perform tasks on RiseFuel’s behalf and therefore RiseFuel must share your Personal Information with these companies to provide services to you. Examples include but are not limited to processing payments, handling billing disputes and collections, analyzing data, providing marketing assistance and providing customer service. RiseFuel may partner with third-party services for fraud prevention and/or identity verification.
  • Enforcing RiseFuels rights or protect RiseFuel property and intellectual property;
  • Protecting the rights, property or safety of others, investigate fraud, respond to a government request.
  • RiseFuel believes in good faith that it must disclose such information to prevent imminent physical harm or financial loss.
  • RiseFuel believes in good faith that it must disclose such information to commence an investigation or take action regarding illegal activities or suspected fraud.
  • RiseFuel believes in good faith that it must disclose such information per auditing, compliance, and corporate governance functions.
  • RiseFuel believes in good faith that it must disclose such information to defend RiseFuel in litigation or a regulatory action.
  • RiseFuel believes in good faith that it must disclose such information, or advised to do so by law, such as in response to a subpoena, or similar legal process, including to law enforcement agencies, regulators, and courts in the United States and other countries where we operate.

RiseFuel will not sell your Personal Information to third parties unless RiseFuel is in the process of entering into a merger with another business, acquisition of another business, or the sale of all or a portion of RiseFuel’s assets and the information is needed to support the sale or transfer of business assets. If RiseFuel is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or prominent notice on our Site of any change in ownership or uses of your Personal Information, as well as any choices you may have regarding your Personal Information before it becomes subject to a new privacy statement.

This Privacy statement only governs when and why RiseFuel discloses Personal Information.  This Privacy statement does not apply to the practices of third parties that RiseFuel does not own or control, or individuals that RiseFuel does not employ or manage.  The use of your Personal Information by third parties that you access through the Site is governed by the privacy policies of such parties and is not subject to RiseFuels control.  RiseFuel is not responsible for the privacy or security practices of other websites on the Internet, even those linked to or from the RiseFuel.  We encourage you to ask questions before you disclose your personal information to others.

RiseFuel may disclose information about you that is not personally identifiable. For example, RiseFuel may provide our partners, (such as Hubspot or SalesForce.com), or other third parties with reports that contain aggregated and statistical data about RiseFuel users.

5) Tracking Technologies

RiseFuel implements cookies to store user information and track user activities. User’s web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information. Cookies enable RiseFuel to monitor your activity across sessions of interaction between your device and the Site. Please see #6, Choice and Control, for information on how to refuse cookies.

6) Choice and Control

While RiseFuel does need to collect certain information to make your RiseFuel experience personalized and to conduct transactions for you, RiseFuel wants to give you the ability to control how your information is provided and shared.

  • Email Preferences. For various reasons, RiseFuel may contact you about our services or your activity. If you no longer wish to receive emails from RiseFuel you may opt out of the email as indicated on each and every email correspondence.

  • Cookies and Tracking Devices. You manage how your browser handles cookies and other tracking devices by adjusting the privacy and security settings on your browser. If accessing RiseFuel by a mobile device, you may manage the information your mobile device shares, such as cookies, tracking technologies, and location information, by adjusting your mobile device privacy and security settings.
7) Security of Personal Information

RiseFuel strives to use commercially acceptable means to protect your personal information, however, no method of transmission over the Internet, or method of electronic storage, is 100% secure and therefore RiseFuel cannot guarantee absolute security of your personal information.  RiseFuel strives to maintain a system that reasonably safeguards Personal Information.

8) Privacy Practices of Third Parties.

This Privacy Statement describes the collection, use, and disclosure of information by RiseFuel through the Site. RiseFuel utilizes third parties to provide services to users and also provides links from the Site to other websites. These third parties may have their own privacy policies and may collect, use, and distribute information differently than RiseFuel. RiseFuel encourages all users to read the privacy policies of all third parties.

9) RiseFuel Blog

RiseFuel.com contains a blog and other areas where users may publicly post information, communicate with other users, and submit content they deem relevant for discussion. RiseFuel strongly encourages you to read the RiseFuel Terms of Use (below) carefully prior to posting or engaging in the blog. All the information you post will be accessible to anyone, at any time, with Internet access. Furthermore, RiseFuel strongly advises you to NOT post any personal or identifiable information about yourself or contact information, including address, email, phone numbers, or other means of communicating outside of the blog. Any information you post may be read, collected, and used by others.

10) Changes to this Privacy Statement

RiseFuel may, from time to time, in RiseFuel’s sole, absolute, and unfettered discretion, update this Privacy Statement to clarify our practices or to reflect new or different privacy practices. We encourage all users to periodically review the Privacy Statement.

 

RiseFuel Terms of Use

Though we dislike legalese, the following Terms of Use apply for RiseFuel.com  Weve tried to cut the clutter, and thank you in advance for your patience, compliance, and appropriate usage of the Website

1. Acceptance of the Terms of Use

Welcome to RiseFuel.com (a.k.a. "we" or "us" or the "Company").  We are excited to have you as a user, and welcome you as a member of our community.  The following terms and conditions (collectively, these "Terms of Use") apply to your use of www.RiseFuel.com, including any content, functionality and services offered on or via RiseFuel.com (the "Website").

We want to maintain as personal a relationship as possible, but we ask you to please read the Terms of Service carefully before you start using RiseFuel.com, because by using the Website you accept and agree to be bound and abide by these Terms of Use.

Should you disagree with some of the provisions herein, you can either leave the Website (although well be sad to see you go!), or contact us at info@risefuel.com. RiseFuel.com is all about collaborative relationships, and well be happy to hear your comments and suggestions.

2. Changes to the Terms of Use and the Website

RiseFuel.com is a work in progress, meaning that a lot will change in the near future.  We reserve the right to update the Website and these Terms of Use from time to time, at our discretion and without notice. Nevertheless, this document is public on RiseFuel.com, and you will be able to track the changes for any new version.  Your continued use of the Website following the publishing of updated Terms of Use means that you accept and agree to the changes.

3. Accessing the Website, Security and Privacy

We are working hard to improve the Website, but we cant guarantee that the Website will be up and running 24/7.  We also reserve the right to suspend or restrict access to some or all features to users. In any case, we will not be liable if, for any reason, all or any part of the Website is unavailable at any time or for any period, nor for any data loss (see also section 7 below).

To access certain features of the Website you may have to register by entering your email and choosing a username and password as part of our security procedures. You must treat such information as confidential, not disclosing it to any third party and only using the Website in person.  There is a password reset procedure in case you forget your password, but please notify us of any breach of security.  We highly recommend that you choose a strong password (e.g., one that includes both letters (capital and lowercase) and numbers and at least one symbol) and that you log out from your account at the end of every session.

It is a condition of your use of the Website that all the information you provide on the Website is correct, current and complete.  In the future, you may be asked to provide certain registration details or other information.  As custom for Internet websites, we reserve the right to disable any user account, at any time, in our sole discretion for any or no reason, including, if in our opinion you have failed to comply with any provision of these Terms of Use.

We also do not guarantee that the Website or any content provided on the Website is error free.

4. Intellectual Property Rights and Use Guidelines.

The Website and its entire content, features, and functionality are owned by RiseFuel.com and are protected by United States and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. By using the Website you agree to not copy, modify, create derivative works of, publicly display, publicly perform,  or republish any of our copyrighted material, except to the extent permitted by the Website itself.  Any questions about proper use of material from the Website should be addressed to info@RiseFuel.com.

For purposes of these Terms of Use, the term “Content” includes, without limitation, information, data, text, photographs, videos, audio clips, written posts and comments, software, scripts, graphics, and interactive features generated, provided, or otherwise made accessible on or through the Website.  For the purposes of these Terms of Use, “Content” also includes all User Content (as defined below).

All Content added, created, uploaded, submitted, distributed, or posted to the Website by users (collectively “User Content”), whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such User Content.  You agree that all User Content provided by you is accurate, complete, up-to-date, and in compliance with all applicable laws, rules and regulations.  You acknowledge that all Content, including User Content, accessed by you using the Website is at your own risk and you will be solely responsible for any damage or loss to you or any other party resulting therefrom.  We do not guarantee that any Content you access on or through the Website is or will continue to be accurate.

The Website may contain Content specifically provided by us, our partners, or our users, and such Content is protected by copyrights, trademarks, service marks, patents, trade secrets or other proprietary rights and laws.  You shall abide by and maintain all copyright notices, information, and restrictions contained in any Content accessed through the Website.

You are permitted to use the Website for your personal, non-commercial use, or legitimate business purposes, provided that your activities are lawful and in accordance with these Terms of Use.  Prohibited uses include violation of laws and regulations, hacking  the Website in any manner, or violating the Content Standards set below.  No right, title, or interest in or to the Website or any content on the site is transferred to you, and all rights not expressly granted are reserved.  Any use of the Website not expressly permitted by these Terms of Use is a breach of these Terms of Use and can lead to account termination.

5. User Contributions and Content Standards.  Special Disclaimer for Legal Content.

The Website may contain user generated content, and also may contain message boards, personal web pages, forums, or other interactive features that allow you to upload, post, submit, publish, display or transmit to other Users Content on or through the Website.  All User Content must be lawful, not spammy, and clear of virus or other malware.  More specifically, but without limiting the foregoing, it must comply with the following Content Standards:

  • Not involve commercial activities or sales , such as contests, sweepstakes, and other sales promotions, barter, or advertising.
  • Not give the impression that they emanate from us or any other person or entity, if this is not the case.
6. Law and Copyright Infringement

We do not undertake to review all material before it is posted on the Website, and cannot ensure prompt removal of objectionable material after it has been posted.  Accordingly, we assume no liability for any action or inaction regarding transmissions, communications, or content provided by any user or third party.  In the unlikely event we receive a disclosure request from an authorized party, we reserve the right to disclose user identities when required to do so by the law, including in response to a law enforcement request supported by a valid court order.  You waive and hold harmless the Company from any claims resulting from any action taken by the Company during or as a result of its investigations and from any actions taken as a consequence of investigations by either the Company or law enforcement authorities.

If you believe that any User Content violates your copyright, please follow the procedure set forth by article 512(c) of the DMCA and provide us a written take down notice including the following information:

The service is provided "as is" and "as available". We disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchant-ability or fitness for a particular purpose and non-infringement.  We are not liable for damages, direct or consequential, resulting from your use of the Website, and you agree to defend, indemnify, and hold us harmless from any claims, losses, liability costs, and expenses (including, but not limited to attorneys fees) arising from your violation of any third-partys rights.  You acknowledge that you have only a limited, non-exclusive, nontransferable license to use the Website.  Because the Website is not error or bug free, you agree that you will use it carefully and avoid using it in ways which might result in any loss of your, or any third partys, property or information.

8. Geographic Restrictions

For now, we provide this Website for use only by persons located in the United States. We make no claims that the Website or any of its content is accessible, appropriate, or legal outside of the United States. If you access the Website from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

9. Governing Law and Jurisdiction

These Terms of Use and any dispute or claim arising out of, or related to them, shall be governed by and construed in accordance with the internal laws of the State of North Carolina without giving effect to any choice or conflict of law provision or rule.  Any legal suit, action or proceeding arising out of, or related to, these Terms of Use or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of North Carolina.

10. Waiver and Severability

Our failure to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision.  The Terms of Use constitutes the entire agreement between you and risefuel.com and governs your use of the service, superseding any prior agreements (including, but not limited to, any prior versions of the Terms of Use). If any provision of these Terms of Use is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.
